    The last will and Testament of Elnathan Terry of the Town of
    Norwich in the County of Chenango and State of New York.
    I, Elnathan Terry considering the uncertainty of this mortal
    life and being of sound mind and memory (blessed be almighty
    God for the same) do make and publish this my last Will and Testa-
    ment in the manner and form following that is to say. First, I give and
    bequeath unto my beloved wife All of My real Estate (Excepting
    thirty one acres of land as long as she lives or remains my widow
    with the use of the house and barn. I also absolutely give and beque-
    ath unto my beloved wife one good horse, two cows and ten sheep
    all of the houshold furniture of Every description and all of the provis-
    ion which I may be possessed of at my deceased to be disposed of as
    she thinks proper.
    Item. I give and devise unto my son Thomas K. Terry one acre
    of land upon which his dwelling house now stans also five
    acres of land from the road on the north line of my prem-
    ises.
    Item. I give to my son Alanson Terry twenty five acres of land
    on the South line running west from the river also all of my
    farming tools
    Item. I give to my Esther Barber fifty dollars and to her son El-
    nathan Barber ten dollars to be paid out of my Estate.
    Item. I give to my daughter Selinda Keech fifty-dollars to be paid out of My
    Estate
    Item. I give to my three sons - Elnathan Terry, Thomas K. Terry
    and Alanson Terry all of that part of my Estate which I have
    hereby given to my bloved wife after her decase to be divided equally be-
    tween them, that is in case they the said Elnathan Terry, Thomas K. Terry &
    Alanson Terry pay to the heirs the several Legacies herein mentioned
    Each one paying an Equal share to be paid within ninety days after
    my decease also all the debts one year after my decase,

    Each to be paid out of my Estate and further I hereby appoint my
    beloved wife Mary Terry and my son Elnathan Terry Executrix and
    Executor of this my last Will and Testament hereby revoking all former

    State of New York:
    Chenango County Surrogate's Court SS: At a Surrogate's Court held for
    the County of Chenango at the office of the Surrogate in the village of
    Oxford in said county on the 22 day of March 1841 for the purpose of
    proving and recording the last Will and Testament of Elnathan Terry
    late of the town of Norwich in the County of Chenango now deceased
    as a will of Real Estate and Personal Estate pursuant to the provisions
    of the Revised Statutes of the State of New York and the several acts
    of the Legislature of the State of New York altering and amending
    the same and particularly an act concerning the proof of Wills, Ex
    ecutors and administrators, Guardians & Wards and Surrogates Court,
    passed May 11 1837 On the application of Mary Terry the executrix
    and Elnathan Tery executor named in the said last Will and
    Testament before Samuel McKoon Surrogate of said County.
    On the day and at the place aforesaid the said Elnathan
    Terry the Executor aforesaid appeared and offered the said last
    Will and Testament for proof and Thomas K. Terry, Thurston Will-
    cox & Alanson Terry heirs at law & next of kin of the said deceased
    and Horace Packer special Guardian of Louisa Sweet, Joanna
    Sweet, Miranda Sweet and Lucinda Sweet minor heirs at law
    and next of kin of the said deceased also appeared but did
    not contest the proof or validity of the said will and thereupon
    the said Elnathan Terry produced due proof by affidavit of the
    lawful service of the Citation issued in this cause upon the heir
    and next of kin of the said Elnathan Terry deceased
    by personal service upon the said Horace Packer Special Guar-
    dian aforesaid and upon Thurston Willcox, Elisha Keech and
    Selinda his wife on the 17 day of February 1841. personal service
    upon Benjamin Barber and Alce his wife and Alanson
    Terry on the 19 day of February 1841. personal service upon Hi-
    ram Willcox and Lysander Moore and Esther his wife on the
    22 day of February 1841. personal service upon Archibald Wood
    and Mary his wife on the 23 day of February 1841. and personal
    service upon Charles W. Sweet and Susannah Sweet on the 24 day
    of February 1841 and personal service upon Thomas K. Terry on or about
    the 17 day of February 1841. All of said heirs at law and next of kin
    being resident of the County of Chenango and Service upon Maxon
    Barber and Esther his wife by publishing a copy of the said Citation
    for six weeks successively once in each week in the state paper of the
    State of New York previous to this 22 day of March 1841 and thereupon the
    said Elnathan Terry the executor aforesaid produced Watterman
    Mathewson, Benjamin H. Gorton & Reuben Hewit the only subscribing
    Witnesses to the said last Will and Testament who were
    by the said Surrogate duly sworn to prove the said last will
    and Testament and testified as follows:

    Watterman Mathewson of the town of New Berlin in the
    County of Chenango one of the subscribing witnesses to an instru-
    ment in writing which purports to be the last will and Testament
    of Elnathan Terry late of the town of Norwich in said County of Che-
    nango being duly sworn deposes and says that he was well ac-
    quainted with Elnathan Terry late of the town of Norwich in Chenango
    County now deceased in his life time & that he saw the said Elnathan
    Terry sign & seal the instrument in writing now produced in Court
    and shown to this deponent & which purports to be the last will and
    Testament of the said Elnathan Terry deceased and heard the said
    Elnathan Terry publish and declare the same to be his last
    Will and Testament that he this deponent set his name thereto
    as a subscribing witness at the same time, at the request of the
    said Elnathan Terry and in his presence and in the presence
    of Benjamin H. Gorton and Reuben Hewit the other subscribing
    witnesses to said instrument in writing who also set their
    names thereto as subscribing witness at the same time at the re-
    quest of the said Elnathan Terry and in his presence &
    in the presence of this deponent and this deponent further
    says that at the time of the execution thereof the said Elna-
    than Terry was over twenty one years of age and was
    of sound mind, memory and understanding in the opinion
    of this deponent and that he executed the same freely and vol-
    untarily or he verily believes. And this deponent further says that
    he wrote the said instrument in writing at the request of the
    said Elnathan Terry deceased as and for his last Will and Tes-
    tament and that before the same was executed by the said
    Elnathan Terry it was either read over by the said Elnathan
    Terry or read over by this deponent in the presence and hear-
    ing of the said Elnathan Terry & that he distinctly recollects
    that the contents of the said instrument in writing were fully
    made known to & understood by the said Elnathan Terry before
    the same was executed - and this deponent further says that
    he has this day in court read over the said instrument in wri-
    ting and that no alteration has been made in the contents there-
    of since its execution and this deponent further says that
    the contents and provisions of the said instrument were direct-
    ed by the said Elnathan Terry deceased. and that the same
    was written agreeably to the direction of the said Elnathan
    Terry deceased and that the same was written at the time
    of its date vis. the twelfth day of July 1839 as near as he can
    recollect.

    The foregoing proofs and Examinations were taken before Me the Surrogate
    aforesaid on the 22nd day of March 1841 at My office in the village of Oxford in the
    County of Chenango and the deposition of Watermann Mathewson, Benjamin H.
    Gorton and Reuben Hewit the only subscribing witnesses to the said will as
    well as the deposition of Elnathan Terry the executor who offered the said
    will for proof were by them severally subscribed after having been first
    carefully read over to them, and I the Surrogate aforesaid being sat-
    isfied upon the said proof before me taken as aforesaid that lawful
    service of the citation issued in this cause had been made upon
    all the heirs at law and next of kin of the said Elnathan Terry
    the Testator deceased that the said will was duly executed and that
    the said Testator at the time of Executing the same was in all respects
    competent to devise Real Estate & not under restraint do therefore allow
    the said will proofs and Examination to be recorded

     Abigail Gibbs was born on 29 June 1728 at Swansea. She was the daughter of Robert Gibbs and Hepziebeth Tisdale. Abigail Gibbs married George Terry, son of Benjamin Terry and Margaret Holloway, on 24 February 1744/45 at Swansea. Her married name was Terry. Abigail Gibbs died after 18 April 1785.
